1. Agreement to Terms

By accessing our website or using our dispatch services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services. These terms apply to all visitors, users, and others who access or use our service.

2. Description of Services

LMXUS Logistics provides freight dispatch services connecting carriers with shippers. Our services include load finding, rate negotiation, documentation support, and carrier relationship management. We are an FMCSA-licensed dispatch company and do not operate as a freight broker.

3. Carrier Agreement

Carriers using our dispatch services must hold valid FMCSA authority, appropriate insurance coverage, and maintain their equipment in DOT-compliant condition. Carriers are independent contractors and are solely responsible for their equipment, drivers, and safe operation of their vehicles.

4. Fees & Payment

Our dispatch fees are charged as a percentage of the gross load rate, as agreed in the individual carrier service agreement. Fees are deducted from carrier settlements. We provide full transparency on all deductions in weekly settlement reports.

5. Limitation of Liability

LMXUS Logistics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the dispatch fees paid by you in the 30 days preceding the claim.

6. Termination

Either party may terminate the dispatch service agreement with 7 days written notice. We reserve the right to suspend services immediately for breach of terms, fraudulent activity, or failure to maintain required insurance or authority.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Dallas County, Texas.

8. Changes to Terms

We reserve the right to modify these terms at any time. We will provide at least 7 days notice before changes take effect by email or notice on our website. Continued use of our services after changes constitutes acceptance of the new terms.
